RESOLUTION NO. R98-1365

A resolution requesting that the State Department of Correction construct no additional correctional facilities in the area of the Metropolitan Government.

WHEREAS, the area of the Metropolitan Government of Nashville and Davidson County presently is the site of several state correctional facilities, as well as numerous jail facilities operated by the Metropolitan Government; and

WHEREAS, the citizens of Metropolitan Government have shared more than their fair burden as a community having a large prison population present; and

WHEREAS, employment opportunities for such facilities are much greater in other counties within the state; and

WHEREAS, on November 18, 1997, the Metropolitan County Council adopted Resolution No. R97-917, as amended, requesting that the State of Tennessee not construct any additional correctional facilities in the area of the Metropolitan Government; and

WHEREAS, there has been public disclosure that the State Department of Corrections is considering adding new correctional facilities in the area of the Metropolitan Government; and

WHEREAS, it is fitting and proper that no further correctional facilities be constructed in the area of the Metropolitan Government.

NOW, THEREFORE, BE IT RESOLVED BY METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Metropolitan County Council hereby goes on record as requesting the State Department of Corrections to construct no additional correctional facilities within the area of the Metropolitan Government.

SECTION 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to Governor Don Sundquist and the Commissioner of the Department of Corrections.

SECTION 3. This Resolution shall take effect from and after its adopting, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Amendment No. 1

To

Resolution No. R98-1365

Mr. President:

I move to amend Resolution No. R98-1365 by adding the following sentence at the end of Section 1:

"This resolution does not waive the existing contractual obligations of the Tennessee Department of Correction to agree to finance additional construction at the Corrections Corporation of America managed Davidson County Detention Facility, when the number of felons sentenced locally to Davidson County exceeds the Facility's capacity.
