RESOLUTION NO. R98-1352

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of the children of Mary L. Cantrell against The Metropolitan Government of Nashville and Davidson County, Joan Cartwright R.N., Chris Whorley, R.N., and Clara Ferguson, R.N. for an amount not to exceed One Hundred Seventy-Five Thousand Dollars ($175,000.00) and directing that this amount be paid from the self-insured liability fund.

Whereas, Mary L. Cantrell while a patient at Nashville General Hospital died as a result of the alleged negligence of the above-named nurse/employees of the Metropolitan Government; and

Whereas, the surviving children of Mary L. Cantrell, namely, Michele F. Yokley, Gay A. Hardin, Deidra S. Cannon and John W. Cantrell, Jr., filed a lawsuit against the Metropolitan Government and the above-named nurse/employees; and

Whereas, the Metropolitan Department of Law after full and complete discovery and investigation believes that the settlement listed in section 1 is fair and reasonable and recommends that this claim be compromised and settled and that this amount be paid from the Self-Insured Liability Fund.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The Metropolitan Department of Law is authorized to compromise and settle all claims of Plaintiffs, Michele F. Yokley, Gay A. Hardin, Deidra S. Cannon and John W. Cantrell, First Circuit Court for Davidson County Docket No. 96C-619, for the amount of one hundred seventy-five thousand dollars ($175,000.00) and that said amount should be paid from the Self-Insured Liability Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
