RESOLUTION NO. R98-1349

A resolution authorizing the Metropolitan Government to enter into Utility Contract No. 5313 with the State of Tennessee, Department of Transportation, for the construction of certain utilities, said construction being necessary as part of State Project Nos. 19018-3219-04 & 19018-3217-04 involving SR-1 (Harding Road) at Harding Place intersection (Metro Project Nos. 97-SG-87 and 97-WG-79).

WHEREAS, in order for the Tennessee Department of Transportation to construct State Projects 19018-3219-04 & 19018-3217-04 involving construction of SR-1 (Harding Rd.) at Harding Place Intersection, it is necessary to adjust or construct certain water lines and/or sewer lines; and

WHEREAS, the estimated cost for the adjustment or construction of the water and/or sewer lines or facilities to the Department of Water and Sewerage Services is $66,385.66, said amount to be used to reimburse the Tennessee Department of Transportation; and

WHEREAS, the Tennessee Department of Transportation desires to start construction of said project and has submitted Utility Contract No. 5313, attached hereto as Exhibit A and made a part of this resolution by reference, for the adjustments or construction of said water and/or sewer lines and facilities.

WHEREAS, the Metropolitan Government is authorized by Ordinance No. 096-326 to enter, by resolution, into Utility Contract No. 5313 with the Tennessee Department of Transportation, attached hereto as Exhibit A and made a part of this resolution by reference.

WHEREAS, this work is identified in METRO’S CAPITAL IMPROVEMENTS BUDGET as Project No. 96-WG-0005.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government is authorized to enter into Utility Contract No. 5313 with the Tennessee Department of Transportation, attached hereto as Exhibit A and made a part of this resolution by reference.

SECTION 2: That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
