RESOLUTION NO. R98-1347

A resolution ratifying an agreement with the City of Oak Hill for the distribution of streets and roads funds for the fiscal year 1998-1999.

Whereas, the Metropolitan Government by virtue of Sections 1.05 and 18.15 of the Metropolitan Charter, has the obligation to provide the governmental function and service of streets and roads within the eitire General Services District, within the boundaries of which the eligible city is located, and to that end, has included in its budget for the General Service District, whether the same be located within or without of the boundaries of municipalities in said General Services District, and has levied taxes to provide funds for same, and

Whereas, the City of Oak Hill is an eligible small city in the General Services District for the distribution of streets and roads funds, and

Whereas, the Metropolitan Government acting thru its Department of Public Works has negotiated with the City of Oak Hill for planning, constructing, and maintaining streets and roads within their boundaries during the fiscal year 1998-1999, and

Whereas, the Metropolitan Government and each eligible city shall enter into an annual agreement concerning the distribution of funds for planning, constructing, and maintaining streets and roads within the boundaries of the eligible cities, and

Whereas, each eligible city shall be compensated at the rate of 12 cents per square yard of streets and roads maintained within the boundaries of each city, and

Whereas, Ordinance No. 87-1935 authorizes the Metropolitan County Mayor to execute any and all agreements necessary for the distribution of streets and roads funds to the eligible city, and

Whereas, Ordinance No. 87-1935 also requires that the agreement between the Metropolitan Government and the eligible city be ratified by resolution of the Metropolitan County Council, and

Be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County, Tennessee:

Section 1: That the agreement between The Metropolitan Government of Nashville and Davidson County and the City of Oak Hill of which is attached hereto and made a part of this resolution, be and the same is hereby ratified by the adoption of this resolution.

Section 2: that the Metropolitan County Mayor is authorized to execute the attached agreement.

Section 3: That this resolution shall take effect from and after its adoption the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
