RESOLUTION NO. R98-1332

A resolution requesting the Davidson County Delegation to the General Assembly to adopt legislation amending Title 8 of the Tennessee Code Annotated to exempt The Metropolitan Government of Nashville and Davidson County from certain fingerprinting requirements due to the advanced fingerprinting technology currently being utilized by the Sheriff and Police Department.

Whereas, Title 8 of Tennessee Code Annotated was recently amended to require law enforcement agencies responsible for maintaining arrested person’s booking records to take two (2) full sets of fingerprints from each person arrested; and

Whereas, advanced fingerprinting technology available and in use by the Sheriff and the Metropolitan Police Department provides for single-digit fingerprinting of person’s who have previously been arrested and the single-digit technology achieves the same result as the taking of a full set of fingerprints; and

Whereas, these fingerprinting requirements impose unnecessary costs and duplication of effort by the Sheriff and the Metropolitan Police Department; and

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the Davidson County Delegation to the 1999 Session of the General Assembly is hereby requested to amend state law, specifically Title 8 of Tennessee Code Annotated to exempt The Metropolitan Government of Nashville and Davidson County from the requirement that two (2) full sets of fingerprints be taken from every person arrested and to further authorize the Metropolitan Government of Nashville and Davidson County to continue to use the single-digit fingerprinting technology already in place.

Section 2. This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
