RESOLUTION NO. R98-1331

A resolution requesting the Davidson County Delegation to the General Assembly to adopt legislation amending Tennessee Code Annotated, Section 7-5-112 to permit The Metropolitan Government of Nashville and Davidson County to establish, operate and maintain all foreign trade zones and subzones established, operated and maintained by the Metropolitan Port Authority upon dissolution.

Whereas, the Metropolitan Port Authority was established by Tennessee Code Annotated, Section 7-5-101, et seq., to create an industrial park on land in Cockrell Bend conveyed to the Metropolitan Government by the State of Tennessee; and

Whereas, to assist the industrial park the Metropolitan Port Authority was empowered to establish, operate and maintain foreign trade zones and subzones for exporting and importing companies; and

Whereas, pursuant to that power the Metropolitan Port Authority established a foreign trade zone operated by Ozburn-Hessey, Inc., and several subzones operated by Nissan and Saturn; and

Whereas, all of the usable real property deeded to the Metropolitan Government has been sold by the Port Authority for industrial development and the State of Tennessee has informed the Metropolitan Government that it does not intend to convey any more property in Cockrell Bend for industrial development by the Metropolitan Port Authority; and

Whereas, the Metropolitan Government is considering dissolution of the Metropolitan Port Authority since its primary mission has been accomplished, but there should be provision to assure the uninterrupted operation of the foreign trade zone and subzones for the economic benefit of Metropolitan Nashville and Davidson County.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the Davidson County Delegation to the 1999 Session of the General Assembly is hereby requested to amend state law, specifically Tennessee Code Annotated, Section 7-5-112, to allow The Metropolitan Government of Nashville and Davidson County to establish, operate and maintain the foreign trade zone and subzones established, operated and maintained by the Metropolitan Port Authority in the event the Port Authority is dissolved.

Section 2. This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
