RESOLUTION NO. R98-1330
A resolution requesting the Davidson County Delegation to the 101st General Assembly to adopt legislation to adopt legislation to amend state law to expressly authorize local governments to regulate local passenger transportation services and to redefine terms describing passenger transportation vehicles such that confusion is eliminated as to the types of vehicles that may be regulated.
Whereas, the provisions of Tennessee Code Annotated, Sections 7-51-1001, et seq., and Sections 65-15-101, et seq., create confusion regarding the ability to regulate taxicabs and other vehicles for hire; and
Whereas, the regulation of taxicabs and other passenger transportation vehicles for hire is most properly the jurisdiction of local authorities; and
Whereas, the definition of terms contained within Tennessee Code Annotated, Section 65-15-102 creates confusion regarding the types of vehicles to be regulated and those to be exempted; and
Whereas, this legislation would authorize local governments to regulate businesses providing local passenger transportation services; and
Whereas, this legislation would redefine terms such that confusion will be eliminated regarding the types of services and vehicles to be regulated.
Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:
Section 1. The Davidson County Delegation to the 101st Session of the General Assembly is hereby requested to amend State law to expressly authorize local governments to regulate local passenger transportation services and to redefine certain terms regarding passenger transportation vehicles.
Section 2. This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
