RESOLUTION NO. R98-1329
A resolution requesting the Davidson County Delegation to the 101st General Assembly to adopt legislation to amend Tennessee Code Annotated, Section 7-51-1001, et seq. to require criminal history disclosures and background checks of taxicab license applicants.
Whereas, the public safety is entrusted to taxicab drivers and taxi service owners; and
Whereas, The Metropolitan Government of Nashville and Davidson County Taxicab and Wrecker Licensing Board is not currently permitted to access national crime information data for applicants for taxicab licenses; and
Whereas, the Federal Bureau of Investigation has advised that only a state statute mandating criminal history background checks would enable municipalities to gain access to such information; and
Whereas, the amendment proposed would mandate criminal history background checks thereby permitting access to national crime information data; and
Whereas, it is in the best interest of the people of Nashville and Davidson County and of visitors to the area, and of the public throughout the State that these background checks be conducted prior to the issuance of a license to operate a taxicab or taxicab service.
Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:
Section 1. The Davidson County Delegation to the 101st Session of the General Assembly is hereby requested to amend State law to require that municipalities and other governmental entities issuing licenses to taxicab drivers and taxicab services obtain criminal history background checks of all applicants prior to issuing any such license.
Section 2. This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
