A resolution approving a contract of employment by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Employee Benefit Board, and James D. Luther.

Whereas, the Metropolitan Employee Benefit Board was created pursuant to Article 13 of the Metropolitan Charter to administer, manage, and coordinate the employee benefit plans of the Metropolitan Government, as well as the retirement plans listed in Section 13.09(a)-(c) of Article 13 of the Charter; and,

Whereas, the Metropolitan Employee Benefit Board desires to continue to employ James D. Luther as the Executive Secretary to the Metropolitan Employee Benefit Board to perform the services as more particularly set out in the contract attached hereto; and,

Whereas, Substitute Ordinance S095-1452 provides such contract may be for up to four (4) years and that such contract of employment be approved by The Metropolitan County Council;

Now, therefore, be it resolved by the council of The Metropolitan Government of Nashville and Davidson County:

Section 1: That the contract by and between The Metropolitan Government of Nashville and Davidson County, acting by and through The Metropolitan Employee Benefit Board and James D. Luther, a copy of which is attached hereto as "Exhibit A" and made a part hereof, is hereby approved under the terms and conditions as set out therein.

Section 2: This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

RESOLUTION NO. R98-1312

Mr. President:

I moved to amend Resolution No. R98-1312 by amending Section 1 thereof by adding the following provision:

"Provided, however, such approval of the contract shall be contingent upon the term of the contract being limited to one (1) year beginning on February 17, 1999, and extending through February 16, 2000."
