Resolution No. R98-1290

A resolution approving a contract for the hauling, excavation, processing and beneficial re-use of municipal waste combustor ash.

WHEREAS, certain ash residue ("Ash") is generated by operation of the Nashville Thermal Transfer Plant; and

WHEREAS, it is the desire of the Metropolitan Government to enter into a contract for the hauling, excavation, processing and beneficial re-use of said Ash; and

WHEREAS, the Metropolitan Government’s Division of Purchasing issued a Request for Proposal, RFP 98-24, seeking an offer to render services described in the preceding paragraph to the Metropolitan Government; and

WHEREAS, the response of American Ash Recycling of Tennessee Ltd. has been determined to be the most advantageous to the Metropolitan Government, taking into consideration price and all other appropriate evaluation factors; and

WHEREAS, the annual cost of the contract with American Ash Recycling of Tennessee is expected to exceed $500,000; and

WHEREAS, Section 4.12.220 of the Metropolitan Code of Laws requires the approval of the Metropolitan Council by resolution of any contract providing for the collection, transportation and/or disposal of solid waste, whether temporary or permanent, providing for annual payment of $500,000 or more; and

WHEREAS, it is in the best interest of the Metropolitan Government to enter into the contract attached in Exhibit 1 hereto, ("the Contract") for the purpose and the term therein described,

BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: The Contract is hereby approved, and the Metropolitan County Mayor is authorized to execute said contract.

SECTION 2: The contract shall not be amended except in accordance with Section 4.24.020 of the Metropolitan Code of Laws. Any renewal of the Contract beyond its original five year term shall require approval of the Metropolitan Council by resolution adopted by twenty-one affirmative votes.

SECTION 3: This Resolution shall become effective from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

RESOLUTION NO. R98-1290

 Mr. President:

I move to amend Resolution No. R98-1290 by adding the following provision to Section 2 thereof:

"The contract between the Metropolitan Government and American Ash Recycling shall be reviewed by the Department of Public Works, Solid Waste Planning Board, and the Metropolitan Council during the next new revision of the Metropolitan Solid Waste Plan."
