RESOLUTION NO. R98-1202

A RESOLUTION AUTHORIZING THE METROPOLITAN GOVERNMENT TO ENTER INTO UTILITY CONTRACT NO. 5323 WITH THE STATE OF TENNESSEE, DEPARTMENT OF TRANSPORTATION, FOR THE CONSTRUCTION OF CERTAIN UTILITIES, SAID CONSTRUCTION BEING NECESSARY AS PART OF STATE PROJECTS 19042-3262-04 & 19042-2261-04 INVOLVING CONSTRUCTION OF SR-45 (OLD HICKORY BLVD.) AT BRICK CHURCH PIKE (METRO PROJECT NOS. 97-SG-94 & 97-WG-85).

WHEREAS, in order for the Tennessee Department of Transportation to construct State Projects 19042-3262-04 & 19042-2261-04 involving construction of SR-45 (Old Hickory Blvd.) at Brick Church Pike, it is necessary to adjust or construct certain water & sewer lines; and

WHEREAS, the estimated cost for the adjustment or construction of the water & sewer lines or facilities to the Department of Water and Sewerage Services is $16,500.00, said amount to be used to reimburse the Tennessee Department of Transportation; and

WHEREAS, the Tennessee Department of Transportation desires to start construction of said project and has submitted Utility Contract No. 5323, attached hereto as Exhibit A and made a part of this resolution by reference, for the adjustments or construction of said water & sewer lines and facilities; and

WHEREAS, The Metropolitan Government is authorized by Ordinance No. 097-852 to enter, by resolution, into Utility Contract No. 5323 with the Tennessee Department of Transportation, attached hereto as Exhibit A and made a part of this resolution by reference.

WHEREAS, this work is identified in METRO’S CAPITAL IMPROVEMENTS BUDGET as Project No. 96-WG-0005.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Mayor is hereby authorized to execute Utility Contract No. 5323 with the Tennessee Department of Transportation, attached hereto as Exhibit A and made a part of this resolution by reference.

SECTION 2: That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
