RESOLUTION NO. R98-1177

A RESOLUTION AUTHORIZING THE METROPOLITAN DEPARTMENT OF LAW TO COMPROMISE AND SETTLE THE CLAIM OF SHELIA WASHINGTON, JAMIE MCAFEE AND RICKY MARTIN AGAINST THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY FOR AN AMOUNT NOT TO EXCEED $10,000.00 AND DIRECTING THAT THIS AMOUNT BE PAID FROM THE SELF INSURED LIABILITY ACCOUNT.

WHEREAS, on October 15, 1997, claimants, Shelia Washington and Jamie McAfee, were involved in a vehicular accident with an automobile owned by The Metropolitan Government of Nashville and Davidson County, that was being driven by David Imhof, an employee of the Metropolitan Government, Department of Police. As a result of the collision, claimants Shelia Washington and Jamie McAffee sustained personal injuries. Further, the vehicle claimant Sheila Washington was driving is owned by claimant Ricky Martin and said vehicle incurred property damage.

WHEREAS, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that the claim be compromised and settled, and that this amount be paid from the Self Insured Liability Account.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. The Metropolitan Department of Law is authorized to compromise and settle all claims filed in a Circuit Court action, Docket No. 98C-395, for a total amount of $10,000, as follows: Shelia Washington for an amount not to exceed $3,000.00; Jamie McAfee for an amount not to exceed $5,475.84; and Ricky Martin for an amount not to exceed $1,524.16. Said amounts shall be paid from the Self Insured Liability Account.

SECTION 2. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
