RESOLUTION NO. R98-1176

A RESOLUTION AUTHORIZING THE METROPOLITAN DEPARTMENT OF LAW TO COMPROMISE AND SETTLE THE CLAIM OF ANNIE DELK AGAINST THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY FOR AN AMOUNT NOT TO EXCEED $13,702.56 AND DIRECTING THAT THIS AMOUNT BE PAID FROM THE SELF INSURED LIABILITY ACCOUNT.

WHEREAS, on October 6 1997, claimant was involved in a vehicular accident with an emergency vehicle owned by The Metropolitan Government of Nashville and Davidson County, that was being driven operated by Christopher Winters, an employee of the Department of Fire. As a result of the collision, claimant sustained personal injury and incurred property damage; and,

WHEREAS, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that the claim be compromised and settled, and that this amount be paid from the Self Insured Liability Account.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. The Metropolitan Department of Law is authorized to compromise and settle the claim of Annie Delk in an amount not to exceed $13,702.56. Said amount shall be paid from the Self Insured Liability Account.

SECTION 2. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
