WHEREAS, the Mayor has submitted an operating budget for fiscal year 1998-1999 which requires an increase of 12 cents in property taxes for the Metropolitan Board of Public Education; and

WHEREAS, such tax increase would provide 2 cents for the school operating budget and 10 cents for capital improvements; and

WHEREAS, the Charter of the Metropolitan Government provides that the Metropolitan Board of Public Education can initiate a referendum election to increase the tax levy for the school budget; and

WHEREAS, the current Metropolitan Board of Public Education submitted and had adopted an amendment to the Charter in 1992 that specifically provided for referendum elections on increase in taxes to provide funding for capital improvements; and

WHEREAS, it is fitting and proper that the proposed school tax increase be submitted to the voters in a referendum election as this is one of only a few issues which legally can be submitted to the public for a vote.

NOW, THEREFORE, BE IT RESOLVED BY THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. The Metropolitan County Council hereby requests the Metropolitan Board of Public Education to initiate a referendum election on the proposed tax increase for public schools.

SECTION 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to the members of the Metropolitan Board of Public Education.

SECTION 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
