RESOLUTION NO. R98-1145
A RESOLUTION AUTHORIZING THE METROPOLITAN DEPARTMENT OF LAW TO COMPROMISE AND SETTLE THE CLAIM OF MICHAEL KERSTETTER AGAINST THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY FOR $40,000 AND DIRECTING THAT THIS AMOUNT BE PAID FROM THE SELF-INSURED LIABILITY ACCOUNT.
WHEREAS, Michael Kerstetter suffered bodily injury while on duty as a deputy employed by the Davidson County Sheriff's Department during an altercation on May 23, 1991, involving inmates housed in the Criminal Justice Center Jail; and
WHEREAS, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and recommends that this claim be compromised and settled, and that this amount be paid from the Self-Insured Liability Account.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: The Metropolitan Department of Law is authorized to compromise and settle all claims of Michael Kerstetter filed in a Circuit Court action, Docket No. 92C-1059 for the amount of $40,000 and that said amount should be paid from the Self-Insured Liability Account.
SECTION 2: This Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
