RESOLUTION NO. R98-1136

A RESOLUTION REQUESTING THE METROPOLITAN POLICE DEPARTMENT AND THE GENERAL SESSIONS COURT TO VIGOROUSLY ENFORCE THE PROHIBITIONS AGAINST EXCESSIVE NOISE FROM SOUND AMPLIFICATION SYSTEMS FROM CAR RADIOS (SECTION 11.12.070).

WHEREAS, Section 11.12.070C prohibits persons, while operating or occupying a motor vehicle, operating or permitting the operating of an amplification of sound systems, including but not limited to any radios, tape players, compact discs players, or other electrical devices, to permit sound that is plainly audible from a distance of fifty (50) feet or more from the motor vehicle; and

WHEREAS, there are numerous operators of motor vehicles violating these provisions which generally disturbs the peace and serenity of the community; and

WHEREAS, it would be fitting and proper that this Metropolitan Code provision be strictly enforced.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Metropolitan County Council hereby requests the Metropolitan Police Department and the General Sessions Courts to strictly enforce the provisions of Section 11.12.070 of the Metropolitan Code relating to excessive noise from automobile radios and entertainment systems.

SECTION 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to the Chief of Police and to each judge of the General Sessions Court.

SECTION 3. This Resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
