ADOPTED 04/07/1998

WHEREAS, Resolution R93-587 requested certain departments, boards and commissions to conduct public hearings on their proposed operating budget not later than April 15 of each year prior to submission of said budget to the Mayor for inclusion in the operating budget; and

WHEREAS, the Metropolitan Charter requires that after submission of the budget from the mayor to the council that a summary of the budget be published in a newspaper of general circulation and that the proposed budget be kept available for public inspection; and

WHEREAS, the Metropolitan Charter further requires that public hearings be conducted by the Metropolitan Council prior to the passage of the operating budget for the Metropolitan Government of Nashville and Davidson County, at which time members of the public are encouraged to provide comment; and

WHEREAS, the additional public hearings required by Resolution R93-587 must be advertised in a newspaper of general circulation at least one week prior to the April 15 deadline; and

WHEREAS, since the passage of this Resolution hearings have been conducted and few, if any, members of the public have attended such hearings; and

WHEREAS, these additional public notice requirements are expensive and this expense, the lack of attendance by the public and, the fact that public comment is obtained in the public hearings before the Metropolitan Council, makes the continuation of this pre-submission public hearing unnecessary and undesirable.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That Resolution R93-587 is hereby repealed.

SECTION 2. This Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
