A RESOLUTION AUTHORIZING THE METROPOLITAN DEPARTMENT OF LAW
TO COMPROMISE AND SETTLE THE CLAIM OF ANNE CANNADY AND THOMAS
CANNADY AGAINST THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON
COUNTY FOR $30,000.00 AND DIRECTING THAT THIS AMOUNT BE PAID FROM
THE SELF-INSURED LIABILITY FUND.
WHEREAS,
Anne Cannady was involved in an automobile accident
with another vehicle at the intersection of 15th Avenue
South and Acklen Avenue and sustained personal injuries and property
damages as a result thereof; and
WHEREAS,
the other driver's view of a stop sign on Acklen Avenue
was totally obscured by tree foliage, and that driver is settling
the Cannadys' claim against her; and
WHEREAS,
the Metropolitan Department of Law believes that the
settlement listed in Section 1 is fair and reasonable and recommends
that this claim be compromised and settled and that this amount
be paid from the Self-Insured Liability Account.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN
GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1. That the Metropolitan Department of Law is
authorized to compromise and settle the claim of Anne Cannady
and Thomas Cannady against the Metropolitan Government of Nashville
and Davidson County for the amount of $30,000.00, which amount
should be paid from the Self-Insured Liability Account.
SECTION 2. That this Resolution shall take effect from
and after its adoption, the welfare of The Metropolitan Government
of Nashville and Davidson County requiring it.
