ORDINANCE BL2017-984

An ordinance amending Title 6, Chapter 6.80, Wreckers and Towing, to increase towing and recovery rates.

WHEREAS, the Transportation Licensing Commission has the exclusive jurisdiction over the licensing and regulation of all vehicles for hire, including wrecker and towing services; and,  

WHEREAS, the public safety is entrusted to wrecker and towing services; and,

WHEREAS, the Transportation Licensing Commission recognizes that business expenses for equipment, insurance, taxes and fuel have increased since the wrecker and towing services’ rates were set in 2012; and,

WHEREAS, the Transportation Licensing Commission approved an increase in wrecker and towing services’ rates on June 22, 2017; and,

WHEREAS, the rate increase is in the best interest of the citizens of The Metropolitan Government of Nashville and Davidson County. 

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.   That Chapter 6.80, 6.80.550 (A)(1)(a), of the Metropolitan Code of Laws is amended by substituting the number “$135.00” for “$125.00.”

Section  2.   That Chapter 6.80, subsection 6.80.550 (A)(1)(b), of the Metropolitan Code of Laws is amended by substituting the number “$145.00” for “$135.00.”

Section 3.   That Chapter 6.80, subsection 6.80.550 (A)(1)(c), of the Metropolitan Code of Laws is amended by substituting the number “$155.00” for “$145.00.”

Section 4.   That Chapter 6.80, subsection 6.80.550 (A)(1)(d)(i), of the Metropolitan Code of Laws is amended by substituting the number “$155.00” for “$145.00.”

Section 5.  That Chapter 6.80, subsection 6.80.550 (A)(1)(d)(ii), of the Metropolitan Code of Laws is amended by substituting the number “$145.00” for “$135.00.”

Section 6.  That Chapter 6.80, subsection 6.80.550(A)(2), of the Metropolitan Code of Laws is amended by substituting “one hundred fifty dollars” for “one hundred fifteen dollars.”

Section 7.  That Chapter 6.80, subsection 6.80.550(A)(3), of the Metropolitan Code of Laws is amended by substituting ”four dollars and fifty cents per mile” for “three dollars and fifty cents per mile.”

Section 8.  That Chapter 6.80, subsection 6.80.550(B)(1) be amended by deleting it in its entirety and replacing it with the following:

1. Base Rates - Base rates apply in the following situations: “Towed vehicles” means those vehicles which can be driven, but are towed to the lot at the request of the owner or police officer. “Wrecked vehicles” means those vehicles that cannot be driven, and must be towed to the lot.

Section 9.  That Chapter 6.80, subsection 6.80.550(B)(2)(e), of the Metropolitan Code of Laws is amended by substituting “five thousand dollars” for “three thousand dollars.”

Section 10.  That Chapter 6.80, subsection 6.80.550(B)(2)(f), of the Metropolitan Code of laws be added to the Metropolitan Code of Laws with the following:

Wrecker companies are authorized to charge a fee of fifty dollars for any winching performed over 50 feet off the road way. 

Section 11.  That Chapter 6.80, subsection 6.80.550(C)(1), of the Metropolitan Code of Laws is amended by substituting “$315.00” for “215.00.”

Section 12.  That Chapter 6.80, subsection 6.80.550(C)(2)(d), of the Metropolitan Code of Laws is amended by substituting “$60.00” for “$35.00.”

Section 13. That Chapter 6.80, subsection 6.80.550(C)(3), of the Metropolitan Code of Laws is amended by substituting “$250.00 for “$175.00.”

Section 14.  That Chapter 6.80, subsection 6.80.550(G), of the Metropolitan Code of Laws is amended by substituting “$75.00 for $55.00 and $175.00 for $140.00.”

Section 15.  That Chapter 6.80, subsection 6.80.550(H)(1) be amended by deleting it in its entirety and replacing it with the following:

1. Towing:

a. Vehicles under seven thousand pounds GVWR: $145.00 maximum
b. Vehicles over seven thousand pounds GVWR: $270.00

 

i. Length of 25 feet and under -- $275.00 maximum
ii. Length over 25 feet -- $375.00 maximum

Section. 16.  That Chapter 6.80, subsection 6.80.550(H)(2), of the Metropolitan Code of Laws is amended by substituting “car” for “vehicle.”

Section 17.  That Chapter 6.80, subsection 6.80.550(I), of the Metropolitan Code of laws is amended by deleting it in its entirety and replacing it with the following:

“In addition to the rates authorized above, wrecker companies are authorized to charge a one-time administrative processing fee of thirty-five dollars for any car remaining in storage on the company lot for twenty four hours, to offset direct costs for notification of the owner or lienholder as required by state law, and an additional twenty-five dollar administration processing fee for each additional notification sent to the owner or lienholder as required by law.”

Section 18.  That Chapter 6.80, subsection 6.80.550(J) be added to the Metropolitan Code of Laws with the following:

“In the event the interior of a salvageable vehicle will be exposed to the elements, wrecker companies are authorized to charge a one-time fee of forty dollars for materials and labor associated with wrapping a vehicle to protect the interiors.”

Section 19.  That any amendment to this ordinance may be approved by resolution of the Metropolitan Council.

Section 20.      This ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1
TO
ORDINANCE NO. BL2017-984

Mr. President –

I move to amend Ordinance No. BL2017-984 as follows:

I. By amending Section 1 by deleting it in its entirety and substituting therefore the following:

Section 1. That Chapter 6.80, 6.80.550 (A)(1)(a), of the Metropolitan Code of Laws is

amended by substituting the number “$155.00”  for “$125.00.”   

II. By amending Section 2 by deleting it in its entirety and substituting therefore the following:

Section 2. That Chapter 6.80, subsection 6.80.550 (A)(1)(b), of the Metropolitan Code of

Laws is amended by substituting the number “$165.00” for “$135.00.”         

III. By amending Section 3 by deleting it in its entirety and substituting therefore the following:

Section 3. That Chapter 6.80, subsection 6.80.550 (A)(1)(c), of the Metropolitan Code of

Laws is amended by substituting the number “$175.00” for “$145.00.”         

IV. By amending Section 4 by deleting it in its entirety and substituting therefore the following:

Section 4. That Chapter 6.80, subsection 6.80.550 (A)(1)(d)(i), of the Metropolitan Code of

Laws is amended by substituting the number “$175.00” for “$145.00.”                           

V. By amending Section 5 by deleting it in its entirety and substituting therefore the following:

Section 5. That Chapter 6.80, subsection 6.80.550 (A)(1)(d)(ii), of the Metropolitan Code of

Laws is amended by substituting the number “$175.00” for “$135.00.”                               

VI. By amending Section 15 by deleting it in its entirety and substituting therefore the following:

Section 15. That Chapter 6.80, subsection 6.80.550(H)(1) be amended by deleting it in its entirety and replacing it with the following:

1. Towing:

a. Vehicles under seven thousand pounds GVWR: $155.00 maximum
b. Vehicles over seven thousand pounds GVWR: $375 maximum

i. Length of 25 feet and under -- $275.00 maximum
ii. Length over 25 feet -- $375.00 maximum
