ORDINANCE BL2017-834

An ordinance amending Section 7.08.140 of the Metropolitan Code of Laws to extend the hours that certain restaurants are permitted to serve beer.

WHEREAS, the State of Tennessee recently enacted House Bill 1289 (2017 Tenn. Pub. Ch. 371) to amend Section 57-4-203(d) of the Tennessee Code Annotated to allow restaurants meeting certain criteria to serve alcoholic beverages at any time of day except for the hour between three o’clock (3:00) a.m. and four o’clock (4:00) a.m.; and

WHEREAS, Section 57-4-102(1) of the Tennessee Code Annotated excludes beer from the definition of “alcoholic beverages”; and

WHEREAS, it is fitting and proper that restaurants be permitted to serve beer during the same times they are permitted to serve alcoholic beverages.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 7.08.140 of the Metropolitan Code is hereby amended by adding the following to the end of subsection D:

“This provision shall not apply to any beer permit holder that is permitted by Section 57-4-203(d)(6) of the Tennessee Code Annotated, as enacted by House Bill 1289 (2017 Tenn. Pub. Ch. 371), to sell or give away alcoholic beverages at any time of day except for the hour between three o’clock (3:00) a.m. and four o’clock (4:00) a.m. Such permit holders may sell, give away, or allow the consumption of beer on their premises during any hours they are permitted by state law to sell or give away alcoholic beverages.”;

Section 2. This Ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
