ORDINANCE BL2017-1032

An ordinance amending Section 7.08.040 of the Metropolitan Code of Laws to application requirements and conditions.

WHEREAS, the Metropolitan Government maintains an interest in balancing the necessary needs of local businesses in conjunction with technological advancements; and,

WHEREAS, in an effort to ensure that existing local businesses and applicants are not being overly burdened by the application process there is a need to update the Metropolitan Code of Laws to allow the Metropolitan Beer Permit Board to accept beer permit applications through multiple methods.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Title 7, Section 7.08.040A of the Metropolitan Code is hereby amended by “deleting one existing Subsection A and replace with a new Subsection A” to read as follows:

A. The owner of any business desiring to sell, distribute, manufacture, or store beer within the metropolitan government area may file an application in person, or by any method deemed acceptable by the metropolitan beer permit board, under oath, for a permit. The application shall be filed at least ten (10) days prior to the date of hearing said application. The board may waive this ten-day requirement if it deems it appropriate. No permit shall be issued until the board has approved the application, which shall contain questions necessary to the determination of whether the applicant has met all laws of this state and all provisions of this code and other ordinances of the metropolitan government then in effect. The form of such application shall be prescribed by the board and approved by the metropolitan department of law.

Section 2. That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
