ORDINANCE BL2017-1007
An ordinance approving a lease agreement between the Metropolitan Government of Nashville and Davidson County and the Electric Power Board of the Metropolitan Government of Nashville and Davidson County to construct a community solar array at 801 Old Due West Avenue (Map/Parcel No. 05100002200), commonly known as the Old Due West Landfill (Proposal No. 2018M-002PR-001).
WHEREAS, The Electric Power Board of The Metropolitan Government of Nashville and Davidson County (hereinafter “NES”) is a municipally-owned electric power distribution company; and,
WHEREAS, NES desires to obtain a lease from The Metropolitan Government of Nashville and Davidson County to construct a community solar array; and,
WHEREAS, The Metropolitan Government of Nashville and Davidson County and NES have identified a parcel of property suitable for Music City Solar, located at the Old Due West Landfill, 801 Old Due West Avenue, Madison, Tennessee (Map/Parcel No. 05100002200), comprising a total of 35 acres with approximately 10 acres of flat usable space on the eastern portion of the site for the solar array; and,
WHEREAS, The Metropolitan Government of Nashville and Davidson County has determined that the lease of said parcel and commencement of said renewable energy initiative will benefit the environment as well as the citizens of Nashville and Davidson County; and,
WHEREAS, The Metropolitan Government of Nashville and Davidson County and NES have negotiated the lease agreement attached hereto and incorporated herein as Exhibit 1; and,
WHEREAS, this ordinance has been mandatorily referred to the Planning Commission pursuant to Section 11.505 of the Metropolitan Charter and has been assigned Proposal No. 2018M-002PR-001, which has been administratively reviewed and recommended for approval; and,
WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this agreement be approved.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the Lease Agreement between The Metropolitan Government of Nashville and Davidson County and NES, attached hereto as Exhibit 1, is hereby approved and the Director of Public Property Administration, or his designee, is hereby authorized to execute the same.
Section 2. That any amendment to this lease agreement shall be approved by resolution of the Metropolitan Council receiving at least twenty-one (21) affirmative votes.
Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
