ORDINANCE NO. BL2015-1042

An ordinance approving the renewal of a ground lease between The Metropolitan Government of Nashville and Davidson County and Eckerd Corporation (Proposal No. 2015M-004PR-001).

WHEREAS, The Metropolitan Government of Nashville and Davidson County, through its Department of Public Works, entered into a ground lease with Eckerd Corporation in 1985 for a portion of excess right-of-way of 25th Avenue North between West End Avenue and Elliston Place, and

WHEREAS, since 1985 Eckerd Corporation has used this property for signage, landscaping and a small number of vehicular parking spaces, and

WHEREAS, The Metropolitan Government of Nashville and Davidson County at Eckerd’s request has negotiated a renewal of said ground lease to permit Eckerd Corporation to continue to use and maintain the property for the stated purposes for a term of thirty (30) years, a copy of which is attached hereto; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2015M-004PR-001 on January 26, 2015 for approval of said ground lease, and

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this ground lease be approved.

NOW, THEREFORE, BE IT ENACTED BY THE METROPOLITAN COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: That the ground lease entered into between The Metropolitan Government of Nashville and Davidson County and Eckerd Corporation, a copy of which is attached hereto and incorporated herein, is hereby approved and the Director of Public Property Administration is authorized to execute the same.

Section 2: That any new amendments to this ground lease shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3: That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
