ORDINANCE NO. BL2013-615

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 720 linear feet of an existing eight inch public sewer main and 170 feet of easement and to accept approximately 364 linear feet of eight inch P.V.C. public sewer main and 160 feet of new sewer easement and 344 feet of eight inch D.I.P. public sewer main and easement for property located at 541 Spence Lane (MWS Project No. 13-SL-0072 and Proposal No. 2013M-049ES-001).

WHEREAS, the abandonment of approximately 720 linear feet of an existing eight inch public sewer main and 170 feet of easement and to accept approximately 364 linear feet of eight inch P.V.C. public sewer main and 160 feet of new sewer easement and 344 feet of eight inch D.I.P. public sewer main and easement for property located at 541 Spence lane are needed to construct MWS project number 13-SL-0072; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2013M-049ES-001 on September 16, 2013, for the abandonment and acceptance of said sewer mains and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 720 linear feet of an existing eight inch public sewer main and 170 feet of easement and to accept approximately 364 linear feet of eight inch P.V.C. public sewer main and 160 feet of new sewer easement and 344 feet of eight inch D.I.P. public sewer main and easement for property located at 541 Spence Lane, as shown on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
