ORDINANCE NO. BL2013-612

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 350 linear feet of an existing eight inch public sewer main and easement and to accept approximately 334 linear feet of eight inch P.V.C. public sewer and 87 linear feet of eight inch D.I.P. public sewer main and easement for properties located at 1400 14th Avenue South, 1441, 1441B, and 1443 12th Avenue South (MWS Project No. 13-SL-56 and Proposal No. 2013M-053ES-001).

WHEREAS, the abandonment of approximately 350 linear feet of an existing eight inch public sewer main and easement and to accept approximately 334 linear feet of eight inch P.V.C. public sewer and 87 linear feet of eight inch D.I.P. public sewer main and easement for properties located at 1400 14th Avenue South, 1441, 1441B, and 1443 12th Avenue South are needed to construct MWS project number 13-SL-56; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2013M-053ES-001 on October 16, 2013, for the abandonment and acceptance of said sewer mains and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 350 linear feet of an existing eight inch public sewer main and easement and to accept approximately 334 linear feet of eight inch P.V.C. public sewer and 87 linear feet of eight inch D.I.P. public sewer main and easement for properties located at 1400 14th Avenue South, 1441, 1441B, and 1443 12th Avenue South, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
