ORDINANCE NO. BL2013-606

An ordinance authorizing the Metropolitan Nashville Arts Commission to accept donations or sponsorships to help cover its costs associated with the Americans for the Arts 2014 Annual Convention; and, appropriating those funds to the Metropolitan Nashville Arts Commission for that purpose.

WHEREAS, on March 5, 2013, the Metropolitan Council approved Ordinance No. BL2013-358 approving an agreement by and between The Metropolitan Government of Nashville and Davidson County, by and through the Metropolitan Nashville Arts Commission, and the Americans for the Arts (“AFTA”) regarding the Americans for the Arts 2014 Annual Convention and Pre-Conference in Nashville, TN, and funding thereof; and,

WHEREAS, the Convention is scheduled to occur from June 12, 2014 through June 15, 2014 in Nashville, TN; and,

WHEREAS, as part of the agreement with AFTA, it was agreed that, although most funds received from third party entities for the convention would be managed within the general budget by AFTA, some funds would be retained by the Arts Commission as specified in the grant or fundraising agreements between the Arts Commission and the third parties; and,

WHEREAS, M.C.L. Section 2.112.040 authorizes the Arts Commission to “accept and receive gifts donated to the commission for artistic and cultural purposes” and to receive and expend money donated to the commission; and,

WHEREAS, the Metropolitan Nashville Arts Commission has started to receive donations or sponsorships from various corporations for the AFTA Convention; and,

WHEREAS, in return for the money given, the sponsor will receive tickets to the convention and/or sponsorship recognition; and,

WHEREAS, the MarketStreet Enterprises LLC, the Metropolitan Airport Authority, and First Tennessee have agreed to sponsor or donate money to help cover the Metropolitan Nashville Arts Commission’s cost associated with the American for the Arts 2014 Annual Convention; and,

WHEREAS, further sponsorships or donations from other third party entities for the Americans for the Arts 2014 Convention are expected in the future.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Arts Commission is authorized to accept the monies or sponsorships from MarketStreet Enterprises LLC, the Metropolitan Airport Authority, First Tennessee and future pledging third parties given to help cover the Metropolitan Nashville Arts Commission’s costs associated with the American for the Arts 2014 Annual Convention.

SECTION 2. That the following monies from MarketStreet Enterprises LLC, the Metropolitan Airport Authority, and First Tennessee are hereby appropriated to the Metropolitan Nashville Arts Commission to cover its costs associated with the Americans for the Arts 2014 Annual Convention:

SECTION 3. That future pledged donations or sponsorships, up to a total of $200,000, intended for the Americans for the Arts 2014 Annual Conference, when received, are hereby appropriated to the Metropolitan Nashville Arts Commission to cover its costs associated with the Americans for the Arts 2014 Annual Convention.

SECTION 4. That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
