ORDINANCE NO. BL2013-605

An Ordinance amending Chapter 6.74 of the Metropolitan Code relating to other passenger vehicles for hire.

WHEREAS, the Metropolitan Government of Nashville and Davidson County (“Metro”) recognizes and understands that tourism is a valuable industry to Metro; and,

WHEREAS, it is in the best interests of Metro to remain competitive with other world class cities that provide tourism and convention center services; and,

WHEREAS, among other things, the federal courts have recognized the legality of the a minimum fee for livery services established by Metro; and

WHEREAS, concern has nevertheless been expressed that the current $45 minimum fee for livery services may reduce competition for passenger vehicle services.

NOW BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 6.74.025 D.1.(b) of the Metropolitan Code is hereby amended by deleting it in its entirety and replacing it with the following language:

“Pre-arranged directly with the livery service or pre-arranged through a third party (e.g., guest service desk, concierge desk or internet-based technology applications).”

Section 2. That Section 6.74.025 D.1.(c ) of the Metropolitan Code is hereby amended by deleting it in its entirety and replacing it with the following language:

“Fare can be determined on a flat fee, time usage, distance or mileage basis. At a minimum, however, the initial charge for using the livery shall be no less than three times the maximum rate for activation of a taximeter charged by taxicabs pursuant to Section 6.72.250 of the Metropolitan Code.”

Section 3. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
