ORDINANCE NO. BL2013-604

An ordinance to amend Chapter 11.12 of the Metropolitan Code pertaining to the noise from buses parked near hotels and motels within the commercial attraction (CA) zoning district.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 11.12.070 of the Metropolitan Code is hereby amended by adding the following provision at the end of subsection C.:

“4. Operate or allow the operation of buses in a parking or staging area if noise from the engine, exhaust, or back-up alert beeper is plainly audible from the nearest exterior wall of a transient lodging establishment within the commercial attraction (CA) zoning district. For purposes of this subsection, ‘plainly audible’ means the detection of the noise by a person using his or her unaided hearing faculties.”

Section 2. This Ordinance shall take effect immediately after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
