ORDINANCE NO. BL2013-598

An ordinance approving and accepting a contribution in the amount of $60,000 from The RESIDENTIAL GROUP via WEV, LLC for signal improvements at the intersection of 31st Avenue North and Long Boulevard.

WHEREAS, The Residential Group via WEV, LLC has plans to develop West End Village in the area of the intersection of 31st Avenue North and Long Boulevard; and,

WHEREAS, said development increased the need of the Metropolitan Government for certain infrastructure improvements at the intersection of 31st Avenue North and Long Boulevard; and,

WHEREAS, in acknowledgement of the foregoing, The Residential Group via WEV, LLC has offered $60,000 to the Metroplitain Government to be used for said infrastructure improvements; and,

WHEREAS, Metropolitan Charter Article 2, Section 2.01(14) authoizes The metropolitan government of Nashville and Davidson County to “accept or refuse gifts, donations, bequests or grants from any source for any purpose related to the powers and duties of the metropolitan government.”

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the contribution of $60,000 from The Residential Group via WEV, LLC is hereby approved and accepted, and shall be deposited in a fund designated by the Director of Finance. (See attached exhibits).

Section 2. That the Department of Public Works shall use these funds for the purposes of signal improvements at the intersection of 31st Avenue North and Long Boulevard, and the funds shall be appropriated for that purpose.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of the st Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
