ORDINANCE NO. BL2013-581

An ordinance authorizing the granting of permanent easements to Piedmont Natural Gas Co. on certain property owned by the Metropolitan Government (Tax Map 070-01-0 Parcel 060.00 and Tax Map 070-00-0 Parcel 037.00) (Proposal No. 2013M-043ES-001).

Whereas, The Metropolitan Government of Nashville and Davidson County owns certain property in Davidson County with an address of 2801 Tucker Rd. and known as Hartman Park (also known as Davidson County Tax Map 070-00-0 Parcel 037.00) and as shown on Exhibit A; and

Whereas, The Metropolitan Government of Nashville & Davidson County owns certain property with an address of 3133 W. Hamilton Avenue in Davidson County located in the same vicinity as Hartman Park and known as Davidson County Tax map 070-01-0 Parcel 060.00 and as shown on Exhibit A; and

Whereas, Piedmont Natural Gas Co. has requested a permanent easement (Exhibit B-1 and B-2) across said property for the purposes of installing and maintaining a natural gas line; and

Whereas, the Metropolitan Board of Parks and Recreation has approved the granting of said easement across the Hartman Park property; and

Whereas, TEMA has approved the granting of said easement across 3133 W. Hamilton Avenue.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The granting of a permanent easement to Piedmont Natural Gas Co. for the purpose of installing and maintaining a natural gas line (as described in the attached Exhibits B-1 and B-2) is hereby approved.

Section 2. The Director of Public Property Administration is authorized to grant said easement and to execute the necessary documents pertaining thereto.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
