ORDINANCE NO. BL2013-579

An ordinance to amend provisions of Metropolitan Code §5.32 relating to the County Clerk’s issuance of a decal as proof of payment of the local motor vehicle regulatory license fee.

WHEREAS, Metropolitan Code of Laws §5.32.110 authorizes the Metropolitan Government to levy a motor vehicle privilege tax, pursuant to Tennessee Code Annotated §5-8-102(b); and

WHEREAS, Tennessee Code Annotated §5-8-102(d)(3) authorizes the county legislative body to determine “whether a resident who operates a motor vehicle in the county shall have a decal or emblem affixed upon the motor vehicle as evidence of compliance” with the motor vehicle privilege tax; and

WHEREAS, Metropolitan Code of Laws §5.32.140 currently requires such decals; and

WHEREAS, the County Clerk has determined that the cost of issuing such decals is approximately $24,000; and

WHEREAS, the County Clerk can continue to collect the motor vehicle tax, and the issuance of the state sticker and registration will be evidence of payment of all state fees and Metro motor vehicle taxes pursuant to Tennessee Code Annotated §55-4-104; and

WHEREAS, not requiring the issuance of the decal will result in savings to the Metropolitan Government; and

WHERAS, the passage of this Ordinance is in the best interests of the citizens of Nashville and Davidson County.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: Section 5.32.100(B) is deleted in its entirety.

Section 2: Section 5.32.100(A) shall be renumbered as 5.32.100.

Section 3: Insert a new subsection (C) to Section 5.32.110 that states: “With the exception of active military personnel, all other owners or operators who register their vehicle(s) within the Metropolitan Government area must pay all applicable regulatory license fees.”

Section 4: Insert the following as the last sentence in Section 5.32.120(B): “The county clerk’s issuance of one sticker, as described in Tennessee Code Annotated §55-4-104(d)(1) shall signify payment of both the state and local taxes and fees.”

Section 5: Section 5.32.140 is amended by deleting the Section in its entirety.

Section 6: This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
