SUBSTITUTE ORDINANCE NO. BL2013-576

An Ordinance amending Chapter 5.04 of the Metropolitan Code to authorize Metropolitan Government departments, agencies, boards, and commissions to submit applications for grants that do not require a local cash match without Council consideration of the application.

WHEREAS, in addition to local tax dollars appropriated by the Metropolitan Council, various Metro departments, agencies, boards, and commissions rely on grants from other governmental and private entities as a source of funding; and

WHEREAS, grant applications are often time sensitive with specific deadlines that cannot be altered; and

WHEREAS, although some grants from the federal government require specific approval of the grant application by the local legislative body, the Metropolitan Government’s practice has been to submit other grant applications for Council approval; and

WHEREAS, certain Metro departments and agencies have sometimes been unable to apply for grants due to tight deadlines that do not coincide with the Council filing deadlines; and

WHEREAS, it is in the best interest of the Metropolitan Government that departments be given the authority to submit grant applications without prior Council approval when no local cash match for the grant is required, provided the application itself does not contain any terms or provisions that would subject the Metropolitan Government or any of its employees to any liability.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Section 5.04.075 of the Metropolitan Code is hereby amended by designating the existing provisions as subsection A. and by adding the following new subsection B.:

B. Grant applications that are not otherwise required to be approved by the Metropolitan Council may be submitted to the grantor by Metropolitan Government departments, agencies, boards, and commissions without being considered by the Metropolitan Council if:
1. The grant, once awarded, would not require a local cash match from the Metropolitan Government;
2. The application itself does not contain any terms or provisions that would subject the Metropolitan Government or any of its employees to any liability; and
3. The Department of Finance and the Department of Law are notified in writing of the grant application at the time it is submitted.

Section 2. That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
