ORDINANCE NO. BL2013-573

An ordinance authorizing the Director of Public Property, or his designee, to accept, execute, and record the attached quitclaim deed from Tennessee Processing Center, LLC to The Metropolitan Government of Nashville and Davidson County for a certain parcel of property located at 2604 Brick Church Pike, the acceptance of which is required for MWS Project No. 11-WC-0024 (Proposal No. 2013M-038PR-001).

WHEREAS, pursuant to the terms of the quitclaim deed attached as Exhibit A to this ordinance, Tennessee Processing Center, LLC has agreed to transfer to the Metropolitan Government of Nashville and Davidson County all the interest it may possess in a parcel of property located at 2604 Brick Church Pike, as is more particularly shown in Exhibit B, hereto (the Property); and,

WHEREAS, the acquisition of the Property is required by the Metropolitan Department of Water and Sewerage Services for the purpose of locating a pumping station upon the Property, consistent with MWS Project No. 11-WC-0024; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2013M-038PR-001 on September 24, 2013, for the acceptance of the Property; and,

WHEREAS, the citizens of Nashville and Davidson County will benefit through the actions contemplated herein.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Director of Public Property, or his designee, is authorized to accept, execute, and record the quitclaim deed attached hereto as Exhibit A, conveying such interest as Tennessee Processing Center, LLC may have in the area described in Exhibit B, hereto attached:

Section 2. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
