ORDINANCE NO. BL2013-571

An ordinance amending Title 6, Chapter 80 of the Metropolitan Code of Laws, pertaining to operation licenses for wrecker services, by adding two new sections, 6.80.165 and 6.80.340 to provide for annual renewal of qualified licenses and biennial renewal of driver’s permits.

WHEREAS, under Title 6, Chapter 80 of the Metropolitan Code of Laws, any person wishing to engage in the business of providing wrecker services within the area of the Metropolitan Government must first obtain an operation license and driver’s permit from the Transportation Licensing Commission; and,

WHEREAS, there is currently no provision for renewal of such license or permit, which results in existing licensees and permit holders applying annually and biennially respectively as new applicants; and,

WHEREAS, providing a mechanism for qualified license and permit holders to renew an operation license or permit will aid in the efficiency of the process.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Council of the Metropolitan Government of Nashville and Davidson County does hereby add to the Metropolitan Code of Laws by creating Section 6.80.165 which shall state the following:

6.80.165 - Annual renewal.

All wrecker operation licenses shall expire annually the year following the date on which the certificate was issued. All certificates may be renewed by the director for each successive year. A renewal fee of one hundred dollars for each approved permit to operate a wrecker shall be charged at the annual renewal of the wrecker operation license. Failure to renew a license prior to its expiration shall result in forfeiture of the license.

Section 2. That the Council of the Metropolitan Government of Nashville and Davidson County does hereby add to the Metropolitan Code of Laws by creating Section 6.80.340 which shall state the following:

6.80.340 - Annual renewal.

All certificates of public convenience and necessity shall expire biennially the second year following the date on which the certificate was issued. All certificates may be renewed by the director for each successive term. A renewal fee in an amount to be established by the commission based upon the cost of processing, including cost of investigation, for each approved permit to operate a wrecker shall be charged at the biennial renewal of the driver’s permit. Failure to renew a permit prior to its expiration shall result in forfeiture of the permit.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring.

Madam President:
I move to amend Ordinance No. BL2013-571 by deleting Section 2 and replacing it with the following:
All driver’s permits shall expire biennially the second year following the date on which the permit was issued. All driver’s permits may be renewed by the director for each successive term. A renewal fee in an amount to be established by the commission based upon the cost of processing, including cost of investigation, for each approved permit to operate a wrecker shall be charged at the biennial renewal of the driver’s permit.
