ORDINANCE NO. BL2013-558

An ordinance approving a donation agreement and accepting the donation of an artwork to the Metropolitan Government of Nashville and Davidson County.

WHEREAS, Oasis Center, Inc. has offered to donate to the Metropolitan Government of Nashville and Davidson County a mosaic sculpture by Sherri Warner Hunter, The Gathering, for no cost to Metro, as long as the sculpture is installed and displayed at Edmondson Park or another Metro location, accessible to the public; and,

WHEREAS, Metropolitan Code §2.112.030 provides that the purpose of the Metropolitan Nashville Arts Commission shall include providing recommendations to the metropolitan county council with respect to the aesthetics of public places and property; and,

WHEREAS, the Metropolitan Nashville Arts Commission has recommended the approval of the attached agreement for the donation and display of artwork; and,

WHEREAS, it is to benefit the citizens of The Metropolitan Government of Nashville and Davidson County that this donation agreement be executed and this donation be accepted.

NOW, THEREFORE BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the donation agreement, attached hereto and incorporated herein, and donation of artwork to The Metropolitan Government of Nashville and Davidson County is hereby approved, to be used for public display, and the Metropolitan Nashville Arts Commission is authorized to execute any and all necessary agreements to accomplish the same.

Section 2. That any amendments, renewals, or extensions of the terms of the agreement shall be approved by resolution of the Metropolitan Council.

Section 3. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
