ORDINANCE NO. BL2013-556

An ordinance authorizing the exchange of vacant property for the purpose of acquiring land for recreational use by the Metropolitan Government (Proposal No. 2013M-035PR-01).

WHEREAS, the Metropolitan Government of Nashville and Davidson County (“Metro”) owns land known as Davidson County Tax Map 079-00-0 Parcel 083.00, also known as 0 Cockrill Bend Circle and shown on Exhibit A; and

WHEREAS, the Metropolitan Nashville Airport Authority (“MNAA”) owns land known as Davidson County Tax Map 120-00-0 Parcel 154.00, also known as 0 Murfreesboro Pike and Davidson County Tax Map 134-00-0 Parcel 012.00, also known as 0 Murfreesboro Pike and both shown on Exhibit B; and

WHEREAS, the Metropolitan Government of Nashville and Davidson County has agreed to exchange of equal value, that certain portion of property as outlined on Exhibit A to Metropolitan Nashville Airport Authority by Quitclaim Deed; and

WHEREAS, the Metropolitan Nashville Airport Authority has agreed to exchange of equal value, that certain portion of property as outlined on Exhibit B to Metropolitan Government of Nashville and Davidson County by Quitclaim Deed; and

WHEREAS, it is in the public interest that land be exchanged for use as Parks Greenway and other Recreational purposes along with expansion of the John Tune Airport.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY;

Section 1. The Director of Public Property is hereby authorized to exchange the land as shown in Exhibits A and B, attached hereto and incorporated herein, for use by Metro Parks and Recreation, the same being for a public purpose and the public convenience requiring it.

Section 2. Any amendment to the described exchange of these properties, for these same purposes, may be authorized by resolution.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
