ORDINANCE NO. BL2013-535

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 160 linear feet of an existing public sewer main and easement and 1,500 linear feet of existing public water main and to accept 1,550 linear feet of eight inch and 12 inch water mains, five fire hydrants, and 207 linear feet of an eight inch sewer line for properties located at 1809 Morena Street and 1807 Albion Street (MWS Project Nos. 13-WL-33 and 13-SL-29 and Proposal No. 2013M-039ES-001).

WHEREAS, the abandonment of approximately 160 linear feet of an existing public sewer main and easement and 1,500 linear feet of existing public water main and the acceptance of 1,550 linear feet of eight inch and 12 inch water mains, five fire hydrants, and 207 linear feet of an eight inch sewer line for properties located at 1809 Morena Street and 1807 Albion Street are needed to construct MWS project numbers 13-WL-33 and 13-SL-29; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2013M-039ES-001 on July 19, 2013, for the abandonment said sewer main and easement and water main and the acceptance of said water mains, fire hydrants, and sewer main.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon said sewer main and easement and water main and to accept said water mains, fire hydrants, and sewer main, for the properties located below as shown on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
