ORDINANCE NO. BL2013-534

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon one sewer manhole and approximately 15 linear feet of an existing public sewer main and to accept one sewer manhole for various properties located along Cartwright Street and Charlotte Avenue (MWS Project No. 13-SL-37 and Proposal No. 2013M-036ES-001).

WHEREAS, the abandonment of the existing sewer manhole and approximately 15 linear feet of an existing public sewer main and the acceptance of one sewer manhole for various properties located along Cartwright Street and Charlotte Avenue are needed to construct MWS project number 13-SL-37; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2013M-036ES-001 on July 2, 2013, for the abandonment and acceptance of said sewer manholes and public sewer main.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon and accept public sewer main and sewer manholes on the property located below as shown on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
