ORDINANCE NO. BL2013-525

An ordinance approving an Agreement by and between the Metropolitan Government, acting by and through its Department of Public Works, Avondale Residential, Inc. and CSX Transportation, Inc. for the construction and acceptance of a roadway bridge over the CSXT right-of-way at Railroad Milepost 00N-15.45- OP No. 432540 Bellevue (Proposal No. 2013M-002OT-001).

WHEREAS, CSX Transportation, Inc. is willing to cooperate with Avondale Residential, Inc. and the Metropolitan Government regarding the construction of a roadway bridge over a CSXT right-of-way at Railroad Milepost 00N-15.45-OP No. 432540 Bellevue Tn. (Proposal No. 2013M-002OT-001) (the “Project”), as shown on the plans attached hereto as Collective Exhibit A, and the dedication and acceptance of said bridge by the Metropolitan Government upon final inspection, pursuant to the terms of the agreement attached hereto as Exhibit B (the “Agreement”); and,

WHEREAS, it is the purpose of said Agreement to provide for the terms and conditions upon which construction of the Project shall proceed and the parties' obligations with respect to the future maintenance and operation of the permanent aspects of the Project.

NOW, THEREFORE BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Agreement for the construction and acceptance of a roadway bridge over a CSXT right-of-way at Railroad Milepost 00N-15.45-OP No. 43540 Bellevue Tn. attached hereto as Exhibit B and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. The acceptance by the Metropolitan Government of the proposed bridge shall be accomplished only by adoption of an ordinance by the Metropolitan Council or as otherwise authorized by the Metropolitan Code.

Section 3. That any amendments, renewals, or extensions of the terms of the Agreement may be approved by resolution of the Metropolitan Council.

Section 4. That this ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
