ORDINANCE NO. BL2013-517

An Ordinance amending Title 2 of the Metropolitan Code pertaining to the use of diversified business enterprises and participation in the Metropolitan Government Workforce Development Program by recipients of economic development incentives.

WHEREAS, a Workforce Development Program was established to assist with the training and hiring of workers for the construction of the new Music City Center; and

WHEREAS, the Development and Funding Agreement between Omni Nashville, LLC, and the Convention Center Authority of the Metropolitan Government for the construction of an Omni convention center headquarters hotel includes provisions pertaining to the use of diversified business enterprises in the construction of the hotel, as well as a preference for local business participation and local hiring; and

WHEREAS, Omni elected to utilize the Workforce Development Program established for the Music City Center to assist in meeting these participation goals; and

WHEREAS, the fiscal year 2013-2014 operating budget of the Metropolitan Government includes funding for the Workforce Development Program as part of the Mayor’s Office of Economic and Community Development; and

WHEREAS, it is in the best interest of the residents of Metropolitan Nashville and Davidson County that participation in the Workforce Development Program and diversified business enterprise participation goals be required for future economic development incentives offered by the Metropolitan Government.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 2 of the Metropolitan Code is hereby amended by adding the following new Chapter 2.211 – Workforce Development Program:

CHAPTER 2.211 WORKFORCE DEVELOPMENT PROGRAM

2.211.010 Workforce development program established.
There is hereby established as part of the mayor’s office of economic and community development (ECD) a workforce development program for the purpose of providing job training and recruitment to Nashville residents for construction projects for which economic development incentives in the form of tax increment financing (TIF) or payments-in-lieu-of-tax (PILOT) agreements have been provided by the Metropolitan Government.

2.211.020 Diversified business participation.
Private businesses receiving economic development incentives in the form of tax increment financing (TIF) or payments-in-lieu-of-taxes (PILOT) agreements for a construction project or projects shall establish a goal of spending a minimum of twenty percent (20%) of the project’s costs with small, minority-owned, and women-owned business enterprises, commonly referred to as “diversified business enterprises (DBE)”.

2.211.030 Workforce development program participation.

Private businesses receiving economic development incentives in the form of tax increment financing (TIF) or payments-in-lieu-of-taxes (PILOT) agreements for a construction project or projects shall utilize the Metropolitan Government’s workforce development program to ensure that reasonable efforts are made to hire or utilize residents of Davidson County for the project(s).

Section 2. That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
