ORDINANCE NO. BL2013-511

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately two hundred eighteen feet (218) linear feet of an existing thirty-six (36) inch storm water pipe and (contingent upon the installation of a new storm water pipe and easement) for property located at 465 Donelson Pike (Proposal No. 2013M-032ES-001).

WHEREAS, the abandonment of the existing storm water pipe and easements and (contingent upon the installation of the new storm water pipe) for the property located at 465 Donelson Pike is requested by Metro water Services applicant; Mapco Petroleum Inc., owner; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2013M-032ES-001 on June 11, 2013, for the abandonment of said storm water) pipe and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon public storm water pipe and easements on the property located below as shown on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment (contingent upon the installation of a new storm water pipe and easement) authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
