ORDINANCE NO. BL2013-504

An ordinance authorizing the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, to participate with BATTELLE MEMORIAL INSTITUTE to investigate the performance of sewer rehabilitation liners (Project Number 13-SG-0044).

WHEREAS, pursuant to the terms of the participation agreement, attached as Exhibit A, the Metropolitan Government of Nashville and Davidson County, acting by and through the Department and Water and Sewerage Services, and, BATTELLE, acting on behalf of the Environmental Protection Agency, desire to investigate the performance of sewer rehabilitation liners for BATTELLE’s retrospective study of sewer system pipeline rehabilitation methodologies; and,

WHEREAS, pursuant to the terms of the participation agreement, BATTELLE agrees to reimburse the Metropolitan Government’s anticipated costs associated with the project for a total not to exceed $10,400.00; and,

WHEREAS, this participation agreement is deemed to benefit both parties and the general community.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The participation agreement (Exhibit A) between the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, and BATTELLE MEMORIAL INSTITUTE, attached hereto and incorporated herein, is hereby approved, and the Director of Water and Sewerage Services is authorized to execute the same.

Section 2. That the amount of the reimbursement of the anticipated costs associated with the project for a total not to exceed $10,400.00 is hereby appropriated to the Department of Water and Sewerage Services.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
