ORDINANCE NO. BL2013-503

An ordinance approving an agreement between the Metropolitan Government and Global Mall Partnership concerning the exchange of certain parcels of real property (Proposal Number 2013M-017PR-001).

WHEREAS, the Metropolitan Government owns a parcel of real property (the “Metro Property”) located at 5260 Hickory Hollow Parkway, comprising part of the former Hickory Hollow Mall property; and,

WHEREAS, Global Mall Partnership owns a parcel of property (the “GMP Property”) adjacent to the Metro Property; and,

WHEREAS, for the mutual convenience of the parties and pursuant to the terms of the agreement (“Agreement”) attached to this ordinance as Exhibit A, the Metropolitan Government proposes to convey to Global Mall Partnership 2.62 acres currently comprising part of the Metro Property in exchange for the conveyance by Global Mall Partnership to the Metropolitan Government of 2.62 acres currently comprising part of the GMP property; and,

WHEREAS, approval of the Agreement is in the best interests of the Metropolitan Government.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The agreement attached as Exhibit A to this ordinance is hereby approved, and the Metropolitan Mayor or his designee is authorized to execute it on behalf of the Metropolitan Government.

Section 2. The Metropolitan Mayor or his designee is further authorized to execute the quitclaim deed referenced in Exhibit A and such other documents as are customary and necessary to effect the transactions contemplated therein.

Section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
