SUBSTITUTE ORDINANCE NO. BL2013-502
An ordinance relinquishing the Metropolitan Government’s further interest in a building and parcel of property formerly used as the Metropolitan Nashville Police Department’s West Nashville Precinct station and granting a sewer easement on an adjacent tract. (Proposal Number 2013M-023PR-002).
WHEREAS, the Metropolitan Government owns a building and parcel of real property (the “Property”) on Charlotte Pike in Nashville, Tennessee, more particularly described in Exhibit A hereto; and
WHEREAS, the Property was formerly used as the West Nashville Police Precinct station; and
WHEREAS, the deed (the “Deed”) conveying the Property to the Metropolitan Government, of record in Book 7478, page 186 of the Office of the Register of Deeds for Davidson County, Tennessee, provides that ownership of the Property reverts to the grantors in the event the Property is no longer used “for public recreation purposes, for the location of a police precinct or for other public purposes to benefit the citizens of the community in which the property is located;” and
WHEREAS, the Metropolitan Government has no further need for the Property for public purposes; and
WHEREAS, pursuant to the terms of the document attached as Exhibit B to this ordinance, the Metropolitan Government proposes to grant to the owners (“Reversion Owners”) of the reversionary interest created by the Deed an easement (the “Easement”) for a sewer line across a parcel owned by the Metropolitan Government and adjacent to the Property, and
WHEREAS, as reflected in the document attached as Exhibit C to this ordinance, the Reversion Owners have offered to pay $450,000 in exchange for the Metropolitan Government relinquishing its further interest in the Property and granting the Easement.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government hereby relinquishes its interest in the Property as requested by and in exchange for the making of the payment contemplated in Exhibit C.
Section 2. The easement for sewer purposes described in Exhibit B is hereby granted.
Section 3. The Metropolitan Mayor or his designee is further authorized to execute such documents as are customary and necessary to grant the Easement and effect the conveyance of the Property as contemplated herein, including execution and delivery of a quitclaim deed.
Section 3. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
