ORDINANCE NO. BL2013-433

An Ordinance amending Section 10.20.220 of the Metropolitan Code to designate all fees collected for the disposal of excess garbage to be used for recycling.

WHEREAS, the June 2009 report from the Mayor’s Green Ribbon Committee on Environmental Sustainability set a goal of reducing waste in Davidson County by 65% by the year 2020, and recommended a “pay-as-you-throw” solid waste program to encourage recycling; and

WHEREAS, Section 10.20.220 of the Metropolitan Code provides that the Department of Public Works may collect and dispose of excess garbage within the urban services district upon request for such service by the owner and payment of a fee, which fee is to be based upon the actual cost for providing such service; and

WHEREAS, in order to increase recycling services, education, and promotion, it is fitting and proper that the fees collected for the disposal of excess garbage be specifically allocated for recycling purposes.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 10.20.220 of the Metropolitan Code is hereby amended by adding the following provision at the end of subsection G.:

“All fees collected pursuant to this subsection shall be dedicated for use by the department for recycling services and/or recycling education and promotion.”

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
