ORDINANCE NO. BL2013-409

An ordinance approving the Metropolitan Government to abandon approximately one thousand three hundred twenty (1,320) feet of an eight (8) inch sewer main and the associated public utility easement on property located at 2014 Bernard Circle (Proposal No. 2013M-004ES-001).

WHEREAS, the abandonment of the sewer main and associated easements on property located at 2014 Bernard Circle is needed to construct Bruin Hills Phase 1 C, MWS Project No. 13-SL-07; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2013M-004ES-001 on February 11, 2013, for the abandonment of said sewer main and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government is authorized to abandon the sewer main and easements on the property located below and shown on Exhibit 1 which is attached hereto and incorporated by reference:

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
