ORDINANCE NO. BL2013-406

An ordinance approving a lease agreement by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, and the Metropolitan Development and Housing Agency for a portion of The Bridge Building (Proposal No. 2013M-007PR-001).

WHEREAS, the Riverfront Concept Plan was completed in 2007 for the purpose of developing the east bank of the Cumberland River into an asset for the Metropolitan Government; and,

WHEREAS, the Metropolitan Council approved funding for the initial phase of the projects listed in the Riverfront Concept Plan, including the Cumberland Park and the NABRICO building; and,

WHEREAS, a portion of the property owned by the Metropolitan Development and Housing Agency, known as Lot 6 as shown on the Unified Plat of Subdivision of Lots 6, 13 & 14 of the Phase II Subdivision Plat Tennessee NFL Stadium, recorded as Instrument No. 20100929-0077565, Register’s Office of Davidson County, Tennessee, includes the building formerly known as NABRICO building and now known as The Bridge Building (the “Building”); and,

WHEREAS, the Metropolitan Development and Housing Agency proposes to lease a certain portion of the Building as more particularly described in Exhibit C of the Lease Agreement to the Metropolitan Government for use by the Metropolitan Board of Parks and Recreation as an office, restrooms and concessions stand for Cumberland Park, and the Metropolitan Government desires to lease the said portion of the Building from the Metropolitan Development and Housing Agency upon the terms and conditions set forth in the Lease Agreement attached hereto; and,

WHEREAS, the Lease Agreement is for a period of 40 years and in lieu of rent the Metropolitan Government will provide certain janitorial, trash collection, maintenance, repair and replacement services on the portions of the Building owned by the Metropolitan Development and Housing Agency as provided in the Lease Agreement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: That the Lease Agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation and the Metropolitan Development and Housing Agency for the a portion of the Building for use as an office, restrooms and concessions stand for Cumberland Park for a term of forty (40) years, a copy of which is attached hereto as Exhibit 1, is hereby approved and the Metropolitan County Mayor is authorized to execute the same on behalf of the Metropolitan Government.

Section 2: That any further amendments to the Lease Agreement shall be approved by resolution of the Metropolitan Council receiving at least twenty one affirmative votes.

Section 3: That this Ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
