ORDINANCE NO. BL2013-405

An ordinance approving a Sublease Agreement by and between The Metropolitan Government of Nashville and Davidson County and STEM Preparatory Academy (Proposal No. 2013M-008PR-001).

WHEREAS, for approximately ten years Metro has had a lease with the State of Tennessee for the Metro Nashville Public Schools to use a portion of the property at 1250 Foster Avenue, better known as the Tennessee Preparatory School, for its Nashville School of the Arts; and,

WHEREAS, Metro and the State have acted to amend this lease so as to expand the area covered by the lease to include the structure identified as the “Old High School” and the land area immediately around it, and said amendment also allows Metro to sub-let this expanded area to the STEM Preparatory Academy; and,

WHEREAS, Academy desires to utilize the property and improvements for a certified public charter school serving fifth- through eighth-grade students who reside in South Nashville with an integrated focus on a science, technology, engineering and mathematics curriculum; and,

WHEREAS, Metro wishes to sub-let the portion of the leased real property which is commonly known as the Old High School.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The sublease agreement between the Metropolitan Government of Nashville and Davidson County and STEM Preparatory Academy, which is attached hereto and incorporated by reference, is hereby approved and the Directors of the Department of General Services and Public Property Administation are authorized to execute the lease on behalf of the Metropolitan Government.

Section 2. Any amendment, change, or extension to the sublease shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3. That the Director of Department of General Services shall have authority to approve any and all renovation and/or improvement projects presented by and for STEM Preparatory Academy.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
