ORDINANCE NO. BL2013-384

An ordinance adopting the 2013 Analysis of Impediments to Fair Housing Choice and authorizing the Metropolitan Mayor to submit the 2013 Analysis of Impediments to the U.S. Department of Housing and Urban Development.

WHEREAS, The Metropolitan Government of Nashville and Davidson County is the recipient of federal funds through the Consolidated Plan process; and

WHEREAS, by Resolution R94-1396, the Metropolitan Council designated the Metropolitan Development and Housing Agency (“MDHA”) as the lead agency responsible for the preparation of the Consolidated Plan for Housing and Community Development programs for The Metropolitan Government of Nashville and Davidson County; and

WHEREAS, MDHA has prepared the 2013-2018 Consolidated Plan with assistance from WFN Consulting in accordance with federal regulations regarding citizen participation and in consultation with a variety of public and private agencies and concerned individuals; and

WHEREAS, by Ordinance No. BL2013-383, the Metropolitan Council adopted the 2013-2018 Consolidated Plan and authorized the Metropolitan Mayor to submit the Plan to the U.S. Department of Housing and Urban Development (“HUD”); and

WHEREAS, HUD requires that jurisdictions receiving funding through the Consolidated Plan process update their Analysis of Impediments to Fair Housing Choice (“AI”) when developing a new Consolidated Plan to reflect the current fair housing situation in their communities; and

WHEREAS, MDHA has updated the Nashville-Davidson County AI concurrently with the development of the 2013-2018 Consolidated Plan; and

WHEREAS, the public comment period for the proposed 2013 AI began on November 19, 2012 and ended on February 4, 2013, and public hearings were held on December 3, 2012, January 10, and January 29, 2013.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Council adopts the 2013 Analysis of Impediments to Fair Housing Choice, attached hereto, and that the Metropolitan Mayor is authorized to submit the AI to HUD; and

Section 2. That a description of impediments to fair housing choice and recommendations of actions to overcome the effects of the impediments identified through the analysis are included in the AI; and

Section 3. That MDHA is authorized to administer the AI on behalf of The Metropolitan Government of Nashville and Davidson County; and

Section 4. That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
