ORDINANCE NO. BL2013-382

An ordinance relinquishing the Metropolitan Government’s further interest in a building and parcel of property currently housing the Metropolitan Government’s archived records and formerly the Green Hills branch library (Proposal Number 2013M-004PR-001).

WHEREAS, the Metropolitan Government owns a building and parcel of real property (the “Property”) at 3801 Green Hills Village Drive, Nashville, Tennessee 37215 as more particularly described on Exhibit A hereto; and

WHEREAS, the Property formerly housed the Green Hills branch library and currently houses the Metropolitan Government’s archived records; and

WHEREAS, the deed of record in Book 4027, page 113 of the Office of the Register of Deeds for Davidson County, Tennessee (the “Deed”) that conveyed the Property to the Metropolitan Government contains a provision stipulating that ownership of the Property reverts to the grantors in the event the Property is no longer used “for the maintenance and operation of a Public Library branch;” and

WHEREAS, the Metropolitan Government plans to transfer its archived records to another location and has no further need to house a library function at the Property; and

WHEREAS, as reflected in the document attached as Exhibit B to this ordinance, the owners of the reversionary interest created by the Deed have offered to make a substantial donation to the Library Foundation in support of the Metropolitan Government’s public libraries in exchange for the Metropolitan Government disclaiming its further interest in the Property.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government hereby relinquishes its interest in the Property as requested by and in exchange for the making of the donation contemplated in Exhibit B.

Section 2. The Metropolitan Mayor or his designee is further authorized to execute such documents as are customary and necessary to effect the conveyance of the Property as contemplated herein, including execution and delivery of a quitclaim deed.

Section 3. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
